Thank you for choosing to be part of our community at Hobvia, Inc ("Hobvia", "Company", "we", "us", or "our"). Please read these Terms of Use carefully before using the Hobvia application and Services ("App", "Service", "Site"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Use. It is your responsibility to periodically review these Terms of Use to stay informed of updates.
"Hobvia", the Hobvia Logo, and "Meet people through shared interests" are registered trademarks of Hobvia Inc. All other brand or product names may be trademarks or registered trademarks of their respective companies or organizations.
Unless otherwise indicated, the App and Services is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. The Content and the Marks are provided on the App or Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Service and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
According to our Rules, you must: • Respect the rights of other Users. You may not defraud, harass, threaten, or cause distress and/or unwanted attention to other Users. • Not use profanity, obscenities, or other masking characters to disguise such words. • Not use or upload obscene, lewd, slanderous, pornographic, sexually explicit, abusive language or content of any kind. • Not upload content or behave in a manner that sexually exploits, abuses, or endangers children. • Not use or upload violent, insulting, indecent, threatening, harmful, defamatory, hateful, racially or ethnically offensive language or content. • Not organize or be a member of any groups that espouse racist, sexist, anti-religious, anti-ethnic, anti-gay or other discriminatory values. • Not spam, flood, or make duplicate posts, or post commercial solicitations. • Not impersonate any employee or agent of Hobvia or its affiliates. • When you post content covered by intellectual property rights, you grant Hobvia a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content. You can end this license anytime by deleting your content or account. • Not exploit any errors or bugs to gain access to content not available to Users, or to obtain a competitive advantage. Errors and bugs should be reported via "Report a problem" in the "More" screen or at contactus@hobvia.com.
By using the App and Service, you represent and warrant that: 1. You have the legal capacity and agree to comply with these Terms of Use. 2. You are at least 13 years old or the minimum legal age to use social networking apps in your jurisdiction. 3. You will not access the App and Service through automated or non-human means, whether through a bot, script, or otherwise. 4. You will not use the App and Service for any illegal or unauthorized purpose. 5. Your use of the Service will not violate any applicable law or regulation. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account.
Bookings & Cancellations: • Students may cancel a confirmed class booking up to 48 hours before the scheduled start time. Cancellations made within 48 hours of the session are not permitted and the booking fee is non-refundable. • To cancel an eligible booking, tap "Cancel Booking" on your booking card in the Classes tab. The Cancel Booking button is automatically disabled within the 48-hour window. • Refund eligibility for cancellations made more than 48 hours in advance is subject to Hobvia's refund policy in effect at the time of cancellation. Rescheduling by Instructors: • Class hosts (instructors) may reschedule a session up to 4 hours before the scheduled start time. Rescheduling is not permitted within the 4-hour window. • When an instructor reschedules a session, enrolled students will be notified in the app. • Students who are unable to attend the rescheduled time may cancel their booking free of charge within 24 hours of being notified of the reschedule, regardless of the 48-hour cancellation policy.
Safety Guidelines for Attending Classes: • Do not scan the QR code or make any payment before you have physically arrived at the class and verified the session is taking place as described. The QR attendance scan is designed to be completed in person at the class location — it is the mechanism that releases the instructor's payout and confirms your attendance. • Always meet the instructor in person before scanning the QR code. Do not scan a QR code shared with you online, over chat, or via email unless you personally know and fully trust the instructor. Legitimate instructors will never ask you to scan a QR code remotely to "confirm" a booking or release a refund. • If you are attending a class for the first time, meet in a public place, inform someone you trust of your plans, and trust your instincts. If something feels wrong, leave and report the incident to Hobvia. • Write a review after your class — your honest feedback helps other students make informed decisions and rewards great instructors. Reviews can be left from your booking card in the Classes tab. All Payments Must Be Made Through Hobvia: • All class payments on Hobvia are processed exclusively through our secure in-app payment system powered by Stripe. Hobvia never requests payment via bank transfer, Venmo, Zelle, PayPal, cryptocurrency, gift cards, or any method outside the app. • If an instructor asks you to pay through an external link, a third-party payment app, or any channel other than the Hobvia app, do not comply. This is a serious violation of our Terms and a common sign of fraud. Report the instructor immediately using the in-app reporting tools or by contacting contactus@hobvia.com. • Never click on payment links sent to you by email, SMS, or messaging apps claiming to be from Hobvia or an instructor. Hobvia will never send you external payment links. Online Fraud, Scams & Phishing: • Hobvia will never ask for your password, full credit card number, bank account details, or Social Security number via email, phone call, or in-app message. Any communication claiming to be from Hobvia that requests this information is fraudulent. • Be cautious of phishing attempts — fake websites, emails, or messages designed to look like Hobvia communications. Always verify that you are using the official Hobvia app or website before entering any personal or payment information. • Do not respond to unsolicited messages or calls claiming you have won a prize, owe a refund, or must verify your account by clicking a link. These are common scam tactics. • If you receive a suspicious communication that appears to be from Hobvia, contact us directly at contactus@hobvia.com or +1 (415) 379-0746 to verify its authenticity before taking any action. • Hobvia is not responsible for losses resulting from your disclosure of account credentials or payment information to third parties, or from transactions conducted outside of the Hobvia platform. Reporting Concerns: If you suspect fraud, a scam, or any abuse of the Hobvia platform, please report it immediately using the "Report a problem" option in the More screen, or contact us at contactus@hobvia.com. We take all reports seriously and will investigate promptly.
The Hobvia class marketplace — including the ability to book classes as a student and to list and teach classes as an instructor — is currently available to United States residents only. By using the class marketplace, you represent and warrant that you are a resident of the United States. Hobvia reserves the right to restrict access to the class marketplace for users located outside the United States at any time and without prior notice. Payouts to instructors are processed through Stripe Connect and are subject to Stripe's eligibility requirements, which at this time are also limited to US-based bank accounts. We may expand availability to additional countries in the future.
Hobvia offers optional trust and safety features for instructors listing classes on the platform. Identity Verification: Instructors who connect a Stripe account to receive payouts undergo identity verification as part of Stripe's standard account onboarding process, which may include collection and verification of government-issued identification. Instructors who have successfully completed this process are displayed with an "Identity Verified" badge on their profile. This badge indicates only that the instructor's identity was verified by Stripe at the time of account creation; it does not constitute an endorsement of the instructor's qualifications, character, or fitness to teach. Background Checks: Background checks are voluntary and available to instructors who choose to participate. When an instructor completes a background check, Hobvia searches available state criminal records. Instructors who pass are displayed with a "Background Checked" badge on their profile. You acknowledge and agree that: • Background checks are conducted at a single point in time and do not reflect conduct that occurs after the check was completed. • State criminal record searches may not include all jurisdictions or all categories of offense. • A "Background Checked" badge does not guarantee that an instructor has no criminal history in all jurisdictions. • Hobvia does not conduct background checks on students. Limitations and User Responsibility: NOTWITHSTANDING THE ABOVE TRUST FEATURES, HOBVIA MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE SAFETY, SUITABILITY, OR QUALIFICATIONS OF ANY USER. Verification badges are informational tools, not guarantees. You are solely responsible for exercising your own judgment when booking or attending a class, and you meet and interact with other users at your own risk. Hobvia is not responsible for the acts, omissions, or conduct of any user, whether online or in person. We encourage you to exercise appropriate caution — including meeting in public places and informing others of your plans — when meeting someone for the first time through the platform. If you have safety concerns about any user, please report them immediately using the in-app reporting tools or by contacting us at contactus@hobvia.com.
You may not access or use the App for any purpose other than that for which we make the App available. The App may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
We reserve the right, but not the obligation, to: 1. Monitor the App for violations of these Terms of Use. 2. Report any user who, in our sole discretion, violates the law or these Terms of Use to law enforcement authorities. 3. In our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable any of your Contributions or any portion thereof. 4. Remove from the App or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems. 5. Otherwise manage the Service in a manner designed to protect our rights and property.
These Terms of Use shall remain in full force and effect while you use the Service. WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICE TO ANY PERSON FOR ANY REASON, INCLUDING FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE. If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party.
We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Service without notice at any time. We cannot guarantee the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance, resulting in interruptions, delays, or errors. We have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Service during any downtime.
There may be information on the App or Service that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.
We will maintain certain data that you transmit to the Service for the purpose of managing the performance of the Service, as well as data relating to your use of the Service. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Service.
These Terms of Use and your use of the Service are governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles.
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA"). The arbitration will take place in Santa Clara County, California. The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. No arbitration shall be joined with any other proceeding, and there is no right or authority for any Dispute to be arbitrated on a class-action basis. Exceptions: The following Disputes are not subject to binding arbitration: (a) any Disputes seeking to enforce or protect intellectual property rights; (b) any Dispute related to allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.
THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE APP AND SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE'S CONTENT AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, PERSONAL INJURY OR PROPERTY DAMAGE, ANY UNAUTHORIZED ACCESS TO OUR SECURE SERVERS, OR ANY BUGS, VIRUSES, OR TROJAN HORSES WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID, IF ANY, BY YOU TO US.
You agree to defend, indemnify, and hold us harmless, including our affiliates and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) use of the Service; (2) breach of these Terms of Use; (3) any breach of your representations and warranties; (4) your violation of the rights of a third party; or (5) any overt harmful act toward any other user of the Service.
By providing your mobile phone number and creating an account or requesting a verification code, you consent to receive one-time transactional SMS text messages from Hobvia for the purpose of verifying your identity and account security. These messages are sent only when you initiate a sign-in or account-creation request. • Message frequency: One message per verification request. • Standard message and data rates may apply. Message and data rates vary by carrier. • To stop receiving messages, reply STOP to any message you receive from us at any time. After opting out, you will no longer receive SMS messages from Hobvia. • For help or more information, reply HELP to any message, or contact us at contactus@hobvia.com or +1 (415) 379-0746. • Carriers are not liable for delayed or undelivered messages. • You are not required to consent to SMS messages as a condition of purchasing any goods or services. By using our Service and providing your phone number, you acknowledge that you have read and agree to this SMS communications policy.
Visiting the Site, using the Service, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.
These Terms of Use and any policies or operating rules posted by us on the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. If any provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.
